Please read these Terms of Service ("Terms") carefully before using the Smart Flip mobile application or website (collectively, the "Service") operated by Smart Flip ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using Smart Flip, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
Smart Flip grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes. You agree not to:
You retain ownership of all data, photos, documents, and other content you upload to Smart Flip ("Your Content"). By uploading content, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you.
You are solely responsible for Your Content and represent that you have all rights necessary to upload it. We do not review user content and are not responsible for any content you submit.
Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise stated or required by law.
SmartFlip Pro is offered as an auto-renewing subscription with the following plans:
New subscribers may be offered a free trial period (currently 3 days) before billing begins. If you do not cancel before the trial ends, you will be charged the applicable subscription price for the plan you selected.
Your subscription automatically renews for the same length and at the then-current price unless you cancel at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Subscriptions are billed and managed through the app store account you used to subscribe:
You can also manage or cancel your subscription directly within the SmartFlip app from Profile > Subscription > Manage Subscription.
Canceling stops future renewals but does not refund the current billing period. You will retain access to Pro features until the end of the period you've already paid for.
We may change subscription prices from time to time. If we do, we will notify existing subscribers at least 30 days in advance, and any price change will take effect at your next renewal unless you cancel before then.
All rights, title, and interest in and to the Service — including the app, website, logos, text, graphics, and software — are owned by or licensed to Smart Flip. Nothing in these Terms transfers any intellectual property rights to you. The Smart Flip name and logo are trademarks of Smart Flip and may not be used without our prior written consent.
The Service may integrate with or link to third-party services (e.g., app stores, mapping services, material suppliers). We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is governed by their respective terms.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Smart Flip does not provide legal, financial, or construction advice. Any budgets, profit projections, or contractor information within the app are tools for your own planning and should not be relied upon as professional advice.
To the fullest extent permitted by law, Smart Flip and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim or (b) $100.
You agree to indemnify, defend, and hold harmless Smart Flip and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the app settings. Sections of these Terms that by their nature should survive termination will survive.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice via email or an in-app notification. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
